Jaipur: Senior Government Doctor exonerated in fake rape case, to get Rs 5 lakh compensation for Mental Agony
Jaipur: In a major relief to a senior Government doctor who was falsely implicated in a molestation case, Protection of Children from Sexual Offences Act (POCSO) court has acquitted the medical practitioner and pulled up four police officers who were indulged in arresting the doctor and denting his reputation based on bogus evidence.
Taking serious cognizance of the issue, the court also directed the state government to register an FIR and refer the matter to CBI against the officers including the then superintendent of police, deputy superintendent and circle inspector, who were involved in framing the doctor.
The POCSO court further directed the Government of Rajasthan to pay a compensation of Rs 5 lakh to the acquitted doctor, who suffered mental and economic exploitation after being dragged in the fake case of kidnapping and raping a minor which apparently slandered the doctor's social stature.
The victim doctor who suffered for more than a month in judicial custody is identified as Dr Om Prakash Meena, a senior medical officer posted at Gangapur city's government hospital.
It took a year for the medical practitioner to break himself free from the burden of serious allegations of kidnapping and raping a child which was falsely levied on him. He was arrested on February 2018 with a malafide intensions under different Sections of Protection of Children from Sexual Offences Act and a charge sheet was filed and 16 fake witnesses, 32 fake documentaries were furnished as evidence.
Dr Meena was arrested for 40 days before he was granted bail. However, in the court, all the allegations and evidence presented were proved utterly wrong and fake.

Dr Meena's counsel divulged the details of the case and brought it to court's attention the that the minor girl’s family has been into blackmailing and extorting money from various people including retired IAS, lawyers, bankers and some businessmen.
Notably, the medical examination of the girl did not establish that she was raped, the counsel added. He went on pointing out at shocking facts in the case where the girl was found not to be a minor as she herself in her 164 CrPC statement had claimed that she was 18. The girl's mark sheet of Class X in which her date of birth is October 10 2000, also substantiate the point.
Moreover, the timing of the incident as alleged by the girl was 11 pm, yet, the FIR was registered at 8 pm after the so-called victim called the police using her mobile phone after the incident. However, at this point, room for suspicion built as there was no seizure of any mobile phone by the police. This shows deceptive intention to wrongly implicate the doctor in this case.
Deliberating the case, special judge Dinesh Gupta finally acquitted the doctor and directed the additional chief secretary (home) to independently probe and investigate the matter. The court ordered;
“If it is found that the police officers involved in this case including Maman Singh, the then SP, Sawai Madhopur, the then deputy superintendent of police, Narendra Kumar and then then circle inspector, Sadar police station Rewar Mal had done it with a malafide intention and wrongly implicated the doctor, the state government, through its conscious decision may further get an FIR registered and refer it to the CBI.”
The court further directed the state government to pay a compensation of Rs 5 lakh to the doctor for badly defaming his social reputation. The court added;
“If the policemen were found guilty of making a false case, the compensation money should be deducted from their salary,”
Commenting on the case, Dr Meena's counsel told TOI, "All these witnesses and documentary evidence could not sustain in the court and were proved wrong and fake.”
